By accessing or using the website, platform, or telemedicine services provided by Infinity Performance & Wellness (IPW) / Instacare Inc., you acknowledge and agree to the following Terms and Conditions.

Telemedicine Services

IPW provides healthcare services through telemedicine, which may include medical evaluation, consultation, laboratory review, treatment recommendations, prescribing when medically appropriate, and ongoing monitoring.

Telemedicine has limitations and may not be appropriate for every medical condition. The treating licensed healthcare provider will determine whether telemedicine is appropriate based on the patient’s individual circumstances and applicable law.

Emergency Disclaimer

IPW’s website and telemedicine services are not intended for medical emergencies or urgent medical situations.

If you believe you are experiencing a medical emergency, severe or rapidly worsening symptoms, or another situation requiring immediate medical attention, call 911 or go to the nearest emergency room immediately.

Do not use the website, patient portal, messaging system, email, or telemedicine services as a substitute for emergency medical care.

Provider-Patient Relationship

Browsing the IPW website, creating an account, completing forms, submitting medical information, requesting an appointment, or communicating with IPW for administrative purposes does not, by itself, establish a provider-patient relationship.

A provider-patient relationship is established only after an appropriate clinical evaluation by a licensed healthcare provider and acceptance of the patient for care, consistent with applicable professional standards and state law.

No Guarantee of Diagnosis, Prescription, or Treatment

Use of the IPW website or telemedicine platform does not guarantee that you will receive a diagnosis, prescription medication, laboratory order, or specific treatment plan.

All medical decisions are made by the treating licensed healthcare provider using independent clinical judgment. A provider may determine that a requested medication or treatment is not medically appropriate, that additional testing or evaluation is required, or that in-person medical care is more appropriate.

Patient Responsibilities

Patients are responsible for providing complete, truthful, and accurate information regarding their medical history, current medications, allergies, symptoms, laboratory results, and changes in health status.

Patients are also responsible for completing recommended laboratory testing, monitoring, follow-up appointments, and other requirements necessary for the safe continuation of treatment.

Payment and Services

Fees may apply to consultations, laboratory testing, medications, products, subscriptions, or other services. Patients are responsible for reviewing applicable charges before purchasing or receiving services.

Unless otherwise stated or required by law, fees for completed consultations, services, laboratory orders, and pharmacy-dispensed medications are non-refundable once the applicable service has been provided or the order has been processed.

Shipping, Temperature-Sensitive Products, and Returns

Products and medications shipped directly from a pharmacy may be temperature-sensitive or non-temperature-sensitive. Temperature-sensitive products are generally shipped in insulated packaging with cold packs to help maintain appropriate conditions during transit.

Upon receipt, patients should promptly inspect the medication and packaging. If a temperature-sensitive product arrives excessively warm or hot, there is concern regarding medication integrity, or a vial, syringe, or package is damaged, please take clear photographs and contact IPW as soon as possible.

IPW may contact the dispensing pharmacy on the patient’s behalf to request review and replacement. Replacement or reshipment is determined by the dispensing pharmacy and is subject to its policies and discretion. If approved by the pharmacy, a replacement may be provided without additional payment.

Due to the nature of prescription medications and pharmacy-dispensed products, medications generally cannot be returned or refunded because of dissatisfaction, adverse effects, changes in treatment preference, or a decision to discontinue treatment or services, except where otherwise required by law or permitted by the dispensing pharmacy.

Privacy and Medical Records

Instacare Inc./IPW maintains medical records in accordance with applicable federal and state privacy laws, including HIPAA when applicable.

IPW may use or receive information necessary to perform authorized healthcare and administrative functions, including treatment, scheduling, billing, payment processing, customer service, technology support, and care coordination, as permitted by law.

A separate Notice of Privacy Practices describes permitted uses and disclosures of protected health information and explains patient privacy rights. Acknowledgment that you received or were offered access to the Notice of Privacy Practices does not constitute a waiver of your privacy rights.

Third-Party Laboratories and Pharmacies

IPW may coordinate patient care with independent laboratories, pharmacies, payment processors, technology providers, and other third parties. These entities may maintain their own policies, fees, shipping procedures, privacy practices, and terms.

IPW does not control the independent clinical, dispensing, shipping, or operational decisions of third-party pharmacies or laboratories.

Changes to These Terms

IPW may update these Terms and Conditions periodically to reflect changes in services, policies, regulatory requirements, or applicable law. The current version will be made available through the website.

Acceptance

By accessing or using IPW’s website or telemedicine platform, you acknowledge that you have reviewed these Terms and Conditions.

Where required for medical treatment, you may also be asked to review and agree to separate documents, including a Telemedicine Consent, Notice of Privacy Practices, treatment-specific informed consent, financial policies, and other applicable patient agreements.
